Hoof N Paw Labs — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Hoof N Paw Labs website, products, and services (collectively, the “Services”). By purchasing a kit or using our site, you agree to these Terms.

If you do not agree, do not use the Services.

1) Who we are

Hoof N Paw Labs (“we,” “us,” “our”) provides at-home parasite testing kits for pets or farm animals. Kits are for animal use only and not for human diagnostic use.

2) Eligibility & accounts

  • You must be at least 18 years.

  • You’re responsible for the accuracy of your account info and for keeping your login secure.

3) Orders, pricing & payment

  • All prices are shown in U.S. Dollars and are subject to change without notice.

  • We may refuse or cancel any order (e.g., suspected fraud, inventory limits, incorrect pricing). If we cancel after charging you, we’ll promptly issue a refund of the amount paid.

  • Taxes and shipping (if any) will be calculated at checkout. You authorize us (and our payment processor) to charge your selected payment method.

4) Shipping, risk of loss & delivery issues

  • We ship to the address you provide. Risk of loss passes to you upon our delivery to the carrier.

  • If your order arrives damaged or items are missing, email support@hoofnpawlabs.com with photos within 48 hours of delivery; we’ll replace affected items at no cost.

  • If a package is lost in transit or shows delivered but isn’t located, notify us within 7 days so we can investigate and reship when appropriate.

  • Undeliverable/refused packages can be reshipped to a corrected address (reship fee may apply).

5) No returns (health & safety)

All sales are final. Because kits are intended for biological sampling, we cannot accept returns for health, safety, and regulatory reasons. See our “No-Return Policy” for how we still make things right (replacements for damage, lost shipments, order changes before shipping, etc.).

6) What’s in the kit & eco handling

Kits typically include a biodegradable sample zip bag (replacing rigid tubes), wood scoop, prepaid USPS Priority Mail 2-Day® return mailer, paper instructions, and a recyclable kraft shipping box.
After your sample arrives at our lab, we process the sample and responsibly compost/biodegrade the bag through approved channels—no action needed from you.

7) Using the kit; sample consent

By using a kit and sending us a sample, you:

  • Represent that the sample is from an animal and that you’re authorized to submit it.

  • Grant us permission to receive, transport, handle, test, store (temporarily), and dispose of the sample and associated materials in accordance with law and our protocols.

  • Acknowledge that shipping times and environmental conditions may affect testability or turnaround.

8) Results & limitations (not veterinary advice)

  • Test results are provided for informational purposes only. We do NOT diagnose, treat, prescribe, or provide veterinary care.

  • Results depend on sample quality/timing and analytical limits; false negatives/positives can occur. If results seem inconsistent with symptoms, consult your veterinarian and consider retesting.

  • You are responsible for decisions you make based on results and for complying with all applicable laws and veterinary guidance.

9) Turnaround time

We aim to email results within 48-72 hours after the sample reaches our lab. Turnaround is an estimate, not a guarantee, and may vary during peak volumes, weather, or carrier delays.

10) Intellectual property

All site content, logos, graphics, photos, icons, and text are our IP or used with permission. You may not use, copy, or modify them except as allowed by these Terms or with our written consent.

11) Acceptable use

You agree not to:

  • Violate any law or third-party rights;

  • Upload/post anything harmful, misleading, or infringing;

  • Scrape, crawl, reverse engineer, or interfere with the site;

  • Misuse kits or submit human samples.

12) Third-party services & links

Our site may link to third parties (e.g., carriers, payment processors). We’re not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

14) Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.

15) Disclaimers

THE SERVICES AND ALL INFORMATION/RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT RESULTS WILL MEET YOUR REQUIREMENTS.

16) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOK N PAW LABS (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR REVENUE, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE PRODUCT(S) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

17) Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or infringement of any rights of a third party.

18) Dispute resolution; arbitration; class-action waiver

  • Governing law: These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-laws rules.

  • Informal resolution: Contact support@hoofnpawlabs.com and we’ll try to resolve the issue within 30 days.

  • Arbitration: Except for small-claims court matters, any dispute shall be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association.

  • Class-action waiver: You and we waive any right to participate in a class or representative action or proceeding.

19) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest version. Continued use of the Services after changes means you accept the updated Terms.

20) Privacy

Your use of the Services is also governed by our Privacy Policy (how we collect, use, and safeguard data). Please review it carefully.
